You are behind on payments and the lender or servicer has sent a formal notice of default or intent to foreclose. This is NOT the final moment — but it means the clock is running.
The lender files with the Clerk of Court. A hearing date is set. In North Carolina, this step moves toward a trustee sale unless resolved.
The courthouse auction date is scheduled. You will receive notice of the sale date. This is the most critical deadline. Once the sale occurs, options narrow significantly.
The trustee conducts the sale at the courthouse. If a bid is accepted, the upset bid period begins. This is NOT necessarily the final word — but timing is everything at this stage.
After the sale, North Carolina law provides a short window where a higher bid can be filed. This is called the upset bid period. Property owners, heirs, and families often misunderstand what this means and what can still be done.
